Brazos Classifieds - Terms of Use
By using the Brazos Internet's Classified Ads service (the “Service”) you acknowledge receipt of the following Disclosures and Warnings and expressly agree to the following Terms and Conditions of Use as hereafter stated:
DISCLOSURES:
North Texas Cellular, Inc d/b/a Brazos Internet ( “Brazos Internet”) provides this Service for free as a benefit and service to its subscribers and the community. Please patronize those sponsors listed on the pages which help make the free provision of this Service possible.
To reduce abuse of the Service, Brazos Internet has adopted the following security and approval policies:
Accounts with a local e-mail address or e-mail addresses from anonymous providers such as yahoo.com, hotmail.com or gmail.com that have local account information such as a mailing address or phone number will be allowed to post listings immediately. Accounts from anonymous or unverifiable e-mail domains, or whose account information is not local, will have posted listings held for approval. New accounts from anonymous or unverifiable email domains will be subject to review periodically for account verification.
If your account is subject to manual approval for posted listings, and you feel you should become a verified user, please contact Brazos Internet, for verification, during business hours (8:00 a.m. to 5:00 p.m., Central Time).
Each account holder will be required to accept any updates to the Terms and Conditions prior to posting new listings on the Service.
Please keep in mind:
- We reserve the right to remove any listing or account at any time without prior notification to the use if it has violated the Terms and Use of the Service.
- We cannot guarantee the accuracy of any listing or communication; it is the responsibility of the potential buyer or seller to verify authenticity of the other party.
- The Service is intended to be for those who would like to sell, buy, or give away items; announce community events; or are looking for employment or employees. The System is not a political or theological discussion arena and any editorial/opinion listing will be removed.
- We provide the ability to post listings in up to two (2) categories at a time. Duplicate listings or listings that contain similar information from the same user can be removed at the sole discretion of Brazos Internet.
- Do not spam the Service.
- We reserve the right to terminate the Service at any time in our sole discretion.
WARNINGS:
Before using the Service, you should become informed of common scams and frauds which are commonplace on listing services, which may include:
- individuals from overseas wanting a cashier's check cashed and any amount over and above the selling price wired back to the individual who sent the cashier's check, which inevitably turn out to be bogus.
- Work from Home scams
- Listing frauds, often wanting to sell vehicles or animals at an unusually low price and are from out of state.
More information on common fraudulent schemes can be obtained from the Texas Attorney General's office at: http://www.oag.tx.us/consumer and from your local Better Business Bureau.
TERMS AND CONDITIONS OF USE
- Brazos Internet reserves the right at its sole discretion to prohibit specific e-mail addresses, domains and IP addresses from using this Service.
- Brazos Internet reserves the right to remove accounts or listings, without prior warning, at any time.
- Brazos Internet FREE Classified Listing Service is run as a service for the Web community. Brazos Internet cannot and does not take responsibility for the quality or validity of the items listed in the Classified Ads.
- Brazos Internet disclaims any warranties, express or implied, on goods or services listed in the classified Ads. Brazos Internet specifically DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANT- ABILITY OR FITNESS FOR A PARTICULAR PURPOSE of this Service or any component of the Service.
- UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO NEGLIGENCE, SHALL BRAZOS INTERNET BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE MATERIALS IN THIS SITE, EVEN IF BRAZOS INTERNET OR A BRAZOS INTERNET AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.
- In no event shall Brazos Internet's total liability to you for all damages, losses, and causes of action (whether in contract, tort including, but not limited to, negligence), or otherwise exceed the amount paid by you to Brazos Internet, if any, for the services or benefits provided by the Service which give rise to the alleged cause of action.
- Sellers assume all risk and liability arising from their offer or decision to sell or purchase any item from this Service.
- Brazos Internet reserves the right to refuse service to anyone at any time. Pornographic or other “offensive” or other postings which Brazos Internet deems as being in poor taste or inappropriate, and duplicative posts, are prohibited. Brazos Internet will endeavor to remove such postings but has no liability for any failure to monitor or remove such postings. By using the Service you run the risk of encountering materials which may be offensive to you and by using the Service accept such risk.
- Users must be of legal age with the ability to enter into binding contracts.
- The sale of illegal items, including all counterfeit goods, are expressly prohibited. Brazos Internet will terminate the listing of any such items upon notification by the legitimate trademark or copyright holder and the Seller of such items may be subject to suspension.
- Brazos Internet does not assume responsibility for the content or the context of the listings.
- Brazos Internet reserves the right to move listings from one category to another or to end listings as it deems appropriate, in its sole discretion.
- Brazos Internet cannot guarantee preservation of records, and may dispose of information without notice, at its sole discretion.
- Brazos Internet does not assume responsibility for the content or the context of the public display areas such as the bulletin boards or the feedback forums.
- Brazos Internet users may use available information about each other only to the extent necessary to facilitate Brazos Internet related transactions.
- The use of private user information, other than as expressly permitted by these Terms and Conditions, is strictly prohibited.
- Users agree to refrain from “spamming” (sending unsolicited commercial e-mail to other users). Users agree to refrain from reposting ads frequently so as to appear at the top of the new item listing. System abuse of any kind will result in termination of the user's ability to post items on the Classified Ads. No notice will be given and abuse will be determined in Brazos Internet's sole discretion.
- Brazos Internet cannot guarantee that it will notice or prevent any inappropriate use of the Service.
- Brazos Internet cannot guarantee that it will notice or prevent users from registering with false demographic information.
- Brazos Internet cannot guarantee that sellers will complete the sale of an item, or that buyers will go through with the purchase of an item; all risk is taken by the individual buyers and sellers. This includes, but is not limited to, risks associated with dealing with foreign nationals, underage persons, or persons acting under false pretense. Know your trading partner! Practice SAFE Trading!
- Payment terms are to be agreed upon between seller and buyer. Brazos Internet is not involved in the transaction.
- Brazos Internet is not responsible for damage or loss caused by errors in the system or the Internet. The system may be unavailable unexpectedly as a result of errors or circumstances beyond our control. Use the FREE Classifieds at your own risk.
- The Rules and the Terms and Conditions for the Service may be amended from time to time, by Brazos Internet, in its sole discretion.
- Brazos Internet and its subsidiaries or affiliates and each of their employers, officers, directors and agents are hereby released of any liability and held harmless in regard to the above services and users of the Service agrees to indemnify Brazos Internet for all cost and expenses, including reasonable attorney fees, incurred by Brazos Internet in defending claims brought by you or by a person claiming to be damaged by you, with respect to the Service.. The customer agrees that all provisions, charges, collections, services, and negotiations shall be enforced in accordance with the law of the State of Texas.
- Any and all other conditions set forth in the Disclosures above if not reiterated in these Terms and Conditions.
